CAMPO VIEJO TAPAS TRAIL
TERMS & CONDITIONS
1. The promoter is Irish Distillers Limited (“IDL” or “We”), a private company registered in Ireland with company number 23732 and having its registered office at Simmonscourt House, Simmonscourt Road, Ballsbridge, Dublin 4, Ireland.
2. The Campo Viejo Tapas Trail promotion is only open to entry by individuals who are aged 18 years and over (proof of age may be required) and who reside in the Republic of Ireland.
3. The Campo Viejo Tapas Trail is planned to run every Wednesday and Saturday during the Month of June 2011 though this is open to change at any time.
4. Entry into the Campo Viejo Tapas Trail promotion will be deemed to be a full and unconditional acceptance by the applicant of the terms and conditions of this competition. A failure to adhere to these terms and conditions may result in non participation in the Campo Viejo Tapas Trail.
5. Photographs of the Campo Viejo Tapas Trail may be taken and may be required for publicity purposes. Entrants agree by entering this promotion to participate in such publicity including but not limited to the publication of their names and pictures for advertising and/or promotional purposes.
6. IDL reserves the right to vary, cancel, postpone or modify this promotion at any time and for whatever reason and/or amend or withdraw this promotion in whole or in part at any time due to unforeseen circumstances. A full refund will be given to any people or persons who have already paid in these circumstances. IDL is also entitled to vary the promotion.
7. IDL will only use entrant’s details for the purposes of activities in connection with this promotion. Entrant’s personal information will not be used for any other purpose whatsoever without prior permission.
8. IDL does not warrant that any use of or access to the site www.facebook.com/campoviejoireland will be uninterrupted by error or virus free nor will it have any liability for damage caused by hostile software which may infect an entrant’s equipment or property as a result of that participant using or browsing the website.
9. No warranty or guarantee is given by IDL in relation to the promotion and to the fullest extent permitted by law, IDL, its agents and trading partners will not be liable for any loss, injury or damage whatsoever which is suffered or sustained during attendance at the promotion and IDL does not recommend or guarantee the performance of any contractor or other obligations of any third parties associated with the promotion and it will not be liable for any fraud committed by any third party.
10. This competition and these terms and conditions will be governed by Irish law and subject to the exclusive jurisdiction of the Irish Courts.
11. In relation to your content submissions, you are responsible for all. Books or other resources are protected by copyright and should not be uploaded, printed or copied using the Service.
13. You agree not to use the Service:
• For any unlawful purpose;
• To upload, post, email or otherwise communicate material (including but not limited to images) that is or which we consider in our sole discretion obscene, offensive, blasphemous, unlawful, pornographic, menacing, threatening, racist, abusive, harmful, an invasion of privacy or publicity rights, libelous, defamatory, illegal or otherwise objectionable;
• To upload, post, email or otherwise communicate material (including but not limited to images) that you do not have a right to transmit or communicate under any contractual or fiduciary relationship or which infringes any copyright, trade mark, patent, trade secret or other intellectual property right or any moral right of any party;
• To harm minors (anyone aged under 18 years) in any way, including but not limited to, uploading, posting, ordering for print, emailing or otherwise communicating material that violates child pornography laws, child sexual exploitation laws and laws prohibiting the depiction of minors engaged in sexual conduct;
• To upload, post, email or otherwise transmit any material which is likely to cause harm to IDL’s or anyone else’s computer systems, including but not limited to that which contains any virus, code, worm, data, or other files or programmes designed to damage or allow unauthorised access to the Service which may cause any defect, error, malfunction or corruption of the Service;
• For any commercial purposes without the express prior written consent of IDL;
• To impersonate any person or entity, or otherwise to misrepresent your affiliation with a person or entity;
• To collect, intercept or harvest screen names, to collect, intercept or store personal data about other users of the Service or to solicit or attempt to solicit or attempt to discover a user’s password, screen name, uploaded image(s) or other registration information without the user’s express knowledge and prior consent;
• To interfere with or disrupt (or attempt to interfere with or disrupt) the Service or servers or networks connected to the Service, or to disobey any procedures, requirements, regulations or policies of networks connected to the Service;
• To provide any information that is false or misleading, that you do not have a right to disclose or that attempts to hide your identity;
• To resell the Service or any portion of the Service.
14. In relation to your content submissions you hereby confirm that:
• You have the necessary licenses, rights and permission's to use your content submission in the manner intended by IDL and these Terms and Conditions
15. You retain all of your ownership rights to your content submissions. You grant permission for IDL to use and publish your content submissions in any format and through any channel it sees fit.
16. You acknowledge that IDL does not generally pre-screen content but that IDL will have the right (but not the obligation) in its sole discretion to edit, refuse, remove, or move any content that is uploaded to the site for use.
17. IDL reserves the right to block users or websites from accessing www.facebook.com/campoviejoireland without prior notice and for any reason.
17. All content posted onto www.facebook.com/campoviejoireland is entirely subject to the terms and conditions of Facebook. IDL is an entirely separate company and has no affiliations whatsoever to Facebook.
18. You agree that the use of the Service is entirely at your own risk. The Service offered by Facebook is provided without any warranties of any kind. IDL makes no guarantee of availability of the Service.
19. You understand and agree that you are personally responsible for your behaviour in connection with the Service. You agree to indemnify, defend and hold harmless Facebook and IDL, its subsidiaries, affiliated companies, joint ventures, business partners, servants, agents, licensors, employees, agents and any third party information providers to the Service from and against all claims, losses, expenses, damages and costs (including but not limited to direct, incidental, consequential, exemplary and indirect damages), and legal fees, resulting from or arising out of
(a) Content posted to the Campo Viejo Ireland Facebook site or submitted through the Service by you or any other person who accesses the Service using your account / membership or user name
(b) Use or misuse of the Service by you or any other person who accesses the Service using your [account/ membership/ user name]
(c) Any breach of these Terms or
(d) Any breach of any rights of a third party
20. The Campo Viejo Tapas Trail is designed so that the paid participants will visit 5 restaurants in Dublin. Bar Pintxo, The Port House, Salamanca Dame Street, Salamanca St Andrews Street and Havana Tapas Bar. During the trail you will stop off for 30 minutes, in groups of a maximum of 20 persons, at each of the five featured venues, where you will be presented with a selection of three of the restaurant’s tapas. You can choose one tapa from the selection accompanied by a 50CL measure of Campo Viejo.
21) Any persons who are deemed to be unruly, drunk, rude etc by the event organizers can be removed from the promotion at any time by the promotional supervisors.
22) All bookings are made through the website www.facebook.com/campoviejoireland and are only confirmed when €20 has been transferred through PayPal. IDL accepts no responsibility for any loss or inconvenience experienced through the use of PayPal. All transactions will be governed by PayPal and its terms and conditions.
23) This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. You are providing your information to Irish Distillers Pernod Ricard and not to Facebook. The information you provide will only be used for Irish Distillers Pernod Ricard to choose a winner and to contact you about other competitions or about other goods and services which Irish Distillers Pernod Ricard considers may be of interest to you
